8:27 NIGHT UPDATE: Tompkinsville man accused of shooting former sheriff indicted for murder

GLASGOW — Charles Hammer, accused in the death of former Monroe County sheriff and former Tompkinsville police chief Herbert "Sprocket" Proffitt, 82, has been indicted for murder in the case.

A grand jury met Thursday in Tompkinsville and returned an indictment on Hammer, charging him with murder and tampering with physical evidence.

Hammer, 81, allegedly shot Proffitt in his driveway in August while going to fetch the mail. Kentucky State Police officials said Hammer could have been seeking revenge after an arrest in 2002 on charges of harassment, disorderly conduct and resisting arrest.

His attorney, Crystal Thompson, with the Kentucky Department of Public Advocacy, waived a preliminary hearing to have the case bound to Monroe County grand jury in September.
