GLASGOW —
A motion for dismissal on technical grounds was denied in a civil case against Cave City, Barren County and local law enforcement and corrections officers.
Ella June Jones filed a lawsuit in December 2011 against the city of Cave City, Barren County, Cave City Police Officer James Skaggs, Barren County Jailer Matt Mutter, Deputy Jailer Gaye Jones and Deputy Jailer Janice Davidson. Jones’ allegations of false arrest, assault and wrongful imprisonment stemmed from a Dec. 17, 2010 incident. Jones was arrested by Skaggs for alcohol intoxication in a public place and was taken to the Barren County Detention Center. Jail employees alleged that Jones became combative at the jail, and she was charged with third-degree assault of a corrections employee and third-degree terroristic threatening.
Cave City City Attorney Bobby Richardson filed a motion at the beginning of November to have the case dismissed. Richardson argued that Jones initially filed the case incorrectly, having the summonses taken to Bowling Green and served by a Warren County constable, when they should have been served in Barren County. When Jones realized her mistake, the summonses were reissued, but by then it was the beginning of January and past the one-year statute of limitations.
