Lawyer to pay for lawsuit

GLASGOW — Barren County Circuit Judge Phil Patton on Wednesday ordered attorney David Son to reimburse Dr. Bharati Mody $18,543 in fees and an additional $1,048 in expenses incurred in a malpractice suit.

Son served as an attorney for Beverly McDaniel, who alleged that Mody was responsible for the wrongful death of her daughter, Anna Amos. The medical malpractice case alleged that Mody was negligent. However, the case was dismissed on March 20, 2007, because Son’s expert witness, Dr. Jeffrey Pomerance, a neonatology expert from California, denied ever being contacted by Son. The lawyer was unable to provide a deposition from the doctor, violating a statute of Kentucky civil law.

The money must be reimbursed by Nov. 7.
