Deposition request granted in murder case

TOMPKINSVILLE — An order asking for the deposition of a witness in a double homicide case was granted Wednesday in Monroe Circuit Court.

The court agreed during a pretrial conference to allow the deposition to be taken of Michael Emberton, who lives near the house where Paul H. Walden, 40, of 1008 Columbia Ave., Apt. 9, Tompkinsville, allegedly shot and killed Jackie Eubank, 47, and Nicholas Butler, 29, between July 19-20, 2008 at Eubank’s home at 1498 Sulphur Lick Road, Tompkinsville.

Walden was indicted for two counts of first-degree murder on Aug. 9, 2008.

In February, during a pretrial conference, the court granted a motion to allow a T-shirt with a blood stain to be tested for DNA. It also agreed to allow Walden’s attorney, Jason J. Pfeil, to have access to the crime scene.

In addition to granting the order for the deposition, the court agreed to allow an expert witness for Walden and lab officials to coordinate a time to meet and for the case to be continued for another pretrial conference set for July 15 at 9 a.m., according to Monroe Circuit Court records.

Walden remains lodged in the Monroe County Jail.
