BCFC files to dismiss appeal

GLASGOW — The Barren County Fiscal Court has filed a motion in the Kentucky Court of Appeals to dismiss its appeal of an open records circuit court ruling.

The Barren County Fiscal Court has been fighting an ongoing open records legal battle with the Glasgow Daily Times since early May 2012. The Daily Times made a request for investigative records compiled by private investigator Michael J. Ober regarding the Barren County Detention Center. The court’s

denial of the request led to an appeal to Attorney General Jack Conway, in which Conway decided the fiscal court

was unlawfully denying the newspaper’s request to have the records. The fiscal court appealed Conway’s decision to Barren County Circuit Court. In August 2012, there was a brief trial, and Barren County Circuit Court Judge Phil Patton ruled in agreement with the attorney general. Barren County Fiscal Court then appealed that ruling to the Kentucky Court ofAppeals.
